1. Acceptance
By accessing or using Opsius, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.
2. Services
Opsius provides AI-powered analytics, forensic insights, and automation tools for Amazon sellers, including comprehensive access to Amazon SP-API and Advertising API data, third-party market intelligence, and cross-customer benchmarking. Features may evolve as the product develops. We grant you a non-exclusive, revocable license to use the platform in accordance with these Terms.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract. You represent that all account information you provide is accurate.
4. Accounts & Security
- You are responsible for maintaining the confidentiality of your credentials.
- You must promptly notify us of any unauthorized use.
- We may suspend or terminate accounts for violations of these Terms or Amazon's policies.
5. Fees & Payment
Paid plans are billed via Stripe according to the pricing presented at checkout. Fees are non-refundable except as required by law.
6. Data Usage & Compliance
You authorize Opsius to access Amazon SP-API and Amazon Advertising API data on your behalf for the purpose of providing analytics, insights, and automation services. We will use this data solely to provide and improve our services in compliance with Amazon's SP-API and Advertising API Data Protection Policies and Acceptable Use Policies. We also integrate third-party competitive intelligence data (Keepa) and create anonymized, aggregated insights across our customer base to provide industry benchmarks and performance comparisons. You consent to the use of third-party service providers (AWS, Stripe, Postmark, Sentry, Datadog, Clerk) necessary to deliver our services.
6.1 Data Processing & Analytics
Opsius processes your data using advanced pattern-recognition and machine-learning algorithms to identify operational inefficiencies, competitive opportunities, and performance-optimization recommendations. This processing may include historical analysis, cross-customer benchmarking (using anonymized data), and predictive modeling to enhance the accuracy and relevance of our insights.
7. Intellectual Property
All platform content, trademarks, and software are owned by Opsius or its licensors. You may not copy, modify, or distribute without permission.
8. Disclaimer
Opsius is provided "as is" without warranties of any kind. We do not guarantee specific business outcomes.
9. Limitation of Liability
To the maximum extent permitted by law, Opsius shall not be liable for indirect or consequential damages. Our total liability shall not exceed the fees paid in the 12 months preceding the claim.
10. Termination
You may cancel at any time. We may suspend or terminate access for material breach. Sections relating to fees, IP, disclaimers, and liability survive termination.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
12. Changes
We may modify these Terms. Material changes will be notified via email or dashboard. Continued use constitutes acceptance.
